Terms of Service

01Application

1. These Terms of Service (the “Terms”) govern the use of the grow books application and related websites (collectively, the “Service”) provided by Tea (the “Operator”).
2. You may use the Service only after agreeing to these Terms and the Privacy Policy.
3. Individual notices and precautions displayed within the Service form part of these Terms. If they differ from these Terms, the individual notice takes precedence.

02Accounts

1. When you begin using the Service, an anonymous account is created through an action on your device. You may optionally link an Apple or Google account and use it to restore your shelf data.
2. You must provide accurate information and are responsible for managing the authentication information for linked accounts and your devices.
3. Actions performed through your account will be treated as your own unless the Operator confirms that a third party used the account without authorization.
4. If you become aware of unauthorized use or a risk of unauthorized use, contact the Operator promptly.
5. Restoring a shelf from a linked account switches the Service from your current anonymous account to that linked account. Data registered to the anonymous account before the switch is not automatically merged into the linked account.
6. If you are a minor, use the Service only after obtaining consent from a parent, guardian, or other legal representative as required by the laws applicable to your age and place of residence.

03The Service

The Service provides book registration by keyword, ISBN, barcode, manual entry, or CSV; shelf display and arrangement; records of reading status, ratings, reflections, notes, classifications, media type, purchase information, dates, and goals; statistics and retrospectives; image registration; data synchronization; CSV import and export; saving and sharing images; and other related features. Details, supported devices, and availability are as displayed within the Service.

Book information may be obtained from external databases. The Operator does not guarantee that such information is accurate, complete, or current. Please review and correct it as necessary.

The feature that extracts candidate book-spine images from a bookshelf photo provides estimated results generated through image processing. The Operator does not guarantee that the results are accurate or complete. Currently, extraction results are not automatically linked to book information or stored in the Service.

04Paid features and subscriptions

1. In addition to free features, the Service may offer paid features, including automatically renewing subscriptions. Prices, subscription periods, free trials, included features, and other conditions are displayed on the purchase screen.
2. Purchases and payments are processed through Apple’s App Store and are subject to Apple’s terms. The Operator does not directly collect payment information.
3. An automatically renewing subscription renews for the same period unless you cancel it in your Apple ID settings at least 24 hours before the renewal date.
4. After cancellation, paid features remain available until the end of the period shown on the purchase screen. Deleting the app does not cancel a subscription.
5. Except where required by law, refunds are handled according to Apple’s policies and procedures.
6. The Operator may change prices or paid features after advance notice and in accordance with applicable law and platform rules.

05User content

1. Rights in reflections, notes, CSV content, images, and other information you register, import, or upload to the Service (“User Content”) remain with you or the lawful rights holder.
2. You grant the Operator a royalty-free right to handle User Content only to the extent necessary to provide, store, synchronize, back up, display, process and transform images, export data, and maintain the Service. This permission is limited to the purpose of providing the Service.
3. You represent that you have the necessary rights to your User Content and that it does not infringe any third party’s copyright, portrait rights, privacy, or other rights.

06Prohibited conduct

You must not:

• Violate any law, public order and morals, or these Terms
• Infringe the rights, interests, reputation, or privacy of a third party
• Gain unauthorized access, misuse authentication information, or bypass security measures
• Place an excessive load on the Service’s servers or networks
• Transmit programs that interfere with the Service or search for or exploit vulnerabilities
• Copy, modify, reverse engineer, or automatically collect data from the Service by methods not authorized by the Operator
• Impersonate another person, engage in fraud, or use the Service for an unlawful purpose
• Engage in any other conduct the Operator reasonably determines to be inappropriate

07Intellectual property

Copyrights, trademarks, and other intellectual property rights in the Service, its design, software, logos, text, and other content belong to the Operator or the lawful rights holder, excluding User Content and content owned by third parties. These Terms do not transfer any such rights to you.

08External services

The Service may integrate with Apple, Google, Firebase Analytics, Supabase, Cloudflare, RevenueCat, Rakuten, openBD, and other third-party services. Each provider’s terms and privacy policy apply to its services. Changes, suspensions, or disruptions affecting a third-party service may make parts of the Service unavailable. The Privacy Policy describes the information sent and the purposes for which it is used.

09Changes, suspension, and termination

1. The Operator may change, suspend, or terminate all or part of the Service for maintenance, incident response, security, legal compliance, changes to external services, or other reasonable grounds.
2. Except in an emergency, the Operator will provide reasonable advance notice within the Service or on this website of changes or termination that materially affect users.

10Disclaimer and limitation of liability

1. The Operator makes no express or implied warranty that the Service is fit for a particular purpose, accurate, complete, continuous, available, free from defects, or that data will always be preserved.
2. You are responsible for backing up important information when necessary.
3. Except in cases of the Operator’s willful misconduct or gross negligence, the Operator is not liable for indirect or special damages, lost profits, or data loss arising in connection with the Service.
4. If a provision of these Terms is restricted by Japan’s Consumer Contract Act or another mandatory law, that law prevails to the extent of the restriction. Where the Operator is liable for damages without willful misconduct or gross negligence, that liability is limited to ordinary and direct damages.

11Ending use and deleting an account

1. You may stop using the Service and delete your account from the in-app Settings screen or by contacting the Operator. A paid subscription must be canceled separately in your Apple ID settings.
2. If you violate these Terms, the Operator may restrict or suspend your use of the Service without prior notice.
3. Information is handled after your use ends in accordance with the Privacy Policy.

12General terms

Changes to these Terms

In accordance with law, the Operator may revise these Terms after considering the need for the change, the reasonableness of the revised terms, and other relevant circumstances. Material changes will be announced within the Service or on this website before their effective date.

Assignment

You may not assign, transfer, or create a security interest in your position or rights and obligations under these Terms without the Operator’s prior written consent.

Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect.

Governing law and jurisdiction

These Terms are governed by the laws of Japan. Unless otherwise required by law, the Tokyo District Court or Tokyo Summary Court has exclusive jurisdiction as the court of first instance over disputes relating to the Service.
